The Illinois DUI Evaluation Process Explained

crystal lake license reinstatement lawyerThe State of Illinois utilizes a classification system that categorizes drivers convicted of driving under the influence (DUI) according to risk. Convicted drivers are assigned an alcohol education/ treatment program according to their risk level. This program must be completed before they can schedule a hearing before the Secretary of State and have their driving privileges reinstated.

To determine risk, the State requires all defendants to undergo a drug and alcohol use evaluation which will determine if they have a substance abuse problem and assess the likelihood they will re-offend. During the evaluation, the examiner will ask the defendant questions about their past and present use of drugs and alcohol.

The Three Risk Categories

The three risk categories are:

  • Minimal risk: A first-time DUI, without any aggravating factors, will likely place the driver in the lowest risk level classification – minimal risk. Minimal risk drivers are only required to complete 10 hours of DUI risk education.  
  • Moderate risk: Moderate risk drivers are also required to complete 10 hours of DUI risk education. Additionally, they must finish 12 hours of preliminary treatment for alcohol addiction, known as early intervention. The early intervention classes are limited to one three-hour session per week.  
  • Significant risk: The 10 hours DUI risk education requirement remains. Significant risk drivers must also complete a more intensive alcohol treatment program, requiring 20 hours of classes and participation in a continuing care plan.  
  • High risk: Defendants without an alcohol dependency are required to undergo 75 hours of substance abuse treatment and must partake in a continued continuing care plan. If the defendant is deemed alcohol dependent, they may be required to attend in-patient treatment.
